1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from Aegyo K-Pop Store to consumers.

These GTC apply accordingly to contracts for the delivery of tickets, unless explicitly stated otherwise. These GTC only regulate the sale of tickets for specific events specified in the seller's item description and not the execution of these events. For the execution of the events, only the legal provisions apply between the participant and the organizer, as well as any deviating conditions of the organizer. If the seller is not also the organizer, they are not liable for the proper execution of the event, for which only the respective organizer is responsible.

A consumer is any natural person who concludes a legal transaction for a purpose that cannot be predominantly attributed to their commercial or independent professional activity.

2. Contracting Parties

The purchase contract is concluded with Aegyo K-Pop Store, Owner: Elisabeth Eberhard & Beate Dobler-Eberhard, Meisenweg 12, 85055 Ingolstadt.

3. Conclusion of Contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer, but merely an invitation to place an order.

3.2 By clicking the [Buy/Order with obligation to pay] button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by an order confirmation via email immediately after receiving your order.

3.3 When submitting an offer via the seller's order form, the contract text will be saved by the seller after the contract is concluded and transmitted to the customer in text form (e.g., email or letter) after the customer's order has been sent. No further access to the contract text by the seller will be provided.

3.4 Before submitting a binding order via the seller's order form, the customer can identify possible input errors by carefully reading the information displayed on the screen. An effective technical means for better identification of input errors can be the browser's magnification function, which enlarges the display on the screen. The customer can correct their entries within the electronic ordering process using the usual keyboard and mouse functions until they click the button that completes the ordering process. The order is placed in the following steps:

1) Selection of the desired goods
2) Confirmation by clicking the "Add to cart" buttons
3) Review of the information in the shopping cart
4) Clicking the "Checkout" button
5) Binding submission of the order by clicking the "Complete order" button

Before the binding submission of the order, the consumer can return to the internet page where the customer's details are entered and correct input errors by pressing the "Back" button in the internet browser they are using, or cancel the ordering process by closing the internet browser.

3.5 Order processing and contact usually take place via email and automated order processing. The customer must ensure that the email address provided for order processing is correct and valid, so that emails sent by the seller can be received at this address. In particular, the customer must ensure, when using spam filters, that all emails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.

4. Right of Withdrawal

4.1 If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be predominantly attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

4.2 If you, as a consumer, exercise your right of withdrawal in accordance with section 4.1, you shall bear the regular costs of returning the goods.

4.3 Furthermore, the provisions detailed in the following apply to the right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us [Aegyo K-Pop Store, Meisenweg 12, 85055 Ingolstadt, Tel.: 01523-1321626, E-Mail: info@aegyo-kpopstore.de] by means of a clear declaration (e.g., a letter sent by post or an e-mail) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods. We recommend providing a tracking number for returns, as we cannot guarantee a refund in the event of loss of the shipment during transit.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the nature, characteristics and functioning of the goods.

Exclusion or premature expiration of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of newspapers, periodicals or magazines with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

The right of withdrawal expires prematurely for contracts for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.

The right of withdrawal expires prematurely for custom-assembled products such as Mystery Boxes and advent calendars.

The right of withdrawal also expires prematurely for reduced-price items.

Please ensure that you create an unboxing video of your order to provide proof of missing items or missing inclusions. We cannot offer a refund for missing content if the items have been opened and/or no proof of unboxing is provided.

Please note: the outer packaging is only for protecting the contents, i.e., the product itself. Therefore, minor damages to the outer packaging such as slight dents, creases or scratches are not a reason for a complaint. For some products, especially plush toys or similar, product variations (e.g., loose seams, small seam holes, etc.) may occur due to the manufacturing process. These are indicated on the individual product pages. These are also not a reason for a complaint.

General notes

1) Please avoid damaging and contaminating the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.

2) Please do not return the goods to us carriage unpaid.

3) Please note that the aforementioned points 1-2 are not prerequisites for the effective exercise of the right of withdrawal.

5. Prices and Shipping Costs

5.1 The prices stated on the product pages include the statutory VAT and other price components.

5.2 In addition to the stated prices, we charge a flat rate of 6.20 Euros per order for delivery within Germany. The shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system, and on the order page.

5.3 For orders with a value of 80.00 Euros or more, your order is shipping-free.

5.4 Any additional delivery and shipping costs will be indicated separately in the respective product description or in the shopping cart.

6. Delivery

6.1 We will only ship the goods once the full payment has been received by us.

6.2 For orders that include pre-orders, we will only ship the entire delivery once the pre-ordered items have arrived at our premises.

6.3 For our deliveries, we try to reuse as much material as possible to reduce packaging waste in circulation.

6.4 Delivery within Germany and the EU is carried out by DHL.

6.5 When goods are shipped, delivery will be made within the delivery area specified by the seller to the delivery address provided by the customer, unless otherwise agreed. The delivery address specified in the seller's order processing is decisive for the execution of the transaction. If the delivery of the goods fails for reasons for which the customer is responsible, the customer shall bear the reasonable costs incurred by the seller as a result. This does not apply to the costs of dispatch if the customer effectively exercises their right of withdrawal. For the return costs, the provision made in the seller's withdrawal policy applies if the customer effectively exercises their right of withdrawal.

6.6 The delivery time is up to 10 days. We will indicate any deviating delivery times on the respective product page.

6.7 The seller reserves the right to withdraw from the contract in the event of incorrect or improper self-delivery. This applies only if the non-delivery is not the fault of the seller and the seller has concluded a specific hedging transaction with the supplier with due care. The seller will make all reasonable efforts to procure the goods. In the event of unavailability or partial availability of the goods, the customer will be informed immediately and the consideration will be refunded immediately.

6.8 If the customer acts as an entrepreneur, the risk of accidental loss and accidental deterioration of the sold goods passes to the customer as soon as the seller has delivered the item to the forwarding agent, the carrier or the person or institution otherwise designated to carry out the shipment. If the customer acts as a consumer, the risk of accidental loss and accidental deterioration of the sold goods generally only passes with the handover of the goods to the customer or a person authorized to receive them.

6.9 If the seller offers the goods for collection, the customer can pick up the ordered goods during the business hours specified by the seller at the address specified by the seller. In this case, no shipping costs will be charged.

6.10 Vouchers will be provided to the customer as follows:

7. Payment

7.1 Payment is only possible via advance payment.

7.2 If you choose the payment method "advance payment", we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.

8. Retention of Title

The goods remain our property until full payment.

9. Dispute Resolution

We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
