1. Scope of Application

These General Terms and Conditions (GTC) apply to all deliveries made by Aegyo K-Pop Store to consumers.

These Terms and Conditions apply accordingly to contracts for the delivery of tickets, unless expressly stipulated otherwise. These Terms and Conditions govern only the sale of tickets for specific events described in detail in the seller’s product description and do not govern the conduct of these events. The conduct of the events is governed exclusively by the statutory provisions governing the relationship between the participant and the event organizer, as well as any terms and conditions of the event organizer that may differ from these. Unless the seller is also the organizer, the seller is not liable for the proper conduct of the event, for which the respective organizer is solely responsible.

A “consumer” is any natural person who enters into a legal transaction for a purpose that is predominantly neither related to their commercial nor their self-employed professional activity.

2. Contracting Parties

The purchase agreement is entered into with Aegyo K-Pop Store, owned by Elisabeth Eberhard & Beate Dobler-Eberhard, Meisenweg 12, 85055 Ingolstadt.

3. Conclusion of Contract

3.1 The presentation of products in the online store does not constitute a legally binding offer, but merely an invitation to place an order.

3.2 By clicking the [Buy/Place a Binding Order] button, you are placing a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

3.3 When you submit an offer via the seller’s order form, the seller will store the text of the contract after the contract is concluded and send it to you in writing (e.g., by email or letter) after you submit your order. The seller will not make the text of the contract available in any other form.

3.4 Before submitting a binding order via the Seller’s order form, the customer can identify any input errors by carefully reading the information displayed on the screen. An effective technical tool for better identifying input errors is the browser’s zoom function, which enlarges the display on the screen. During the electronic ordering process, the customer can correct their entries using standard keyboard and mouse functions until they click the button that completes the ordering process. The ordering process consists of the following steps:

1) Selection of the desired merchandise
2) Confirmation by clicking the “Add to Cart” button
3) Review of the details in the shopping cart
4) Clicking the “Proceed to Checkout” button
5) Binding submission of the order by clicking the “Complete Order” button

Before submitting the order, the consumer may, after reviewing their information, return to the webpage where the customer’s details are entered by clicking the “Back” button in their web browser to correct any input errors or cancel the ordering process by closing the web browser.

3.5 Order processing and communication generally take place via email and automated order processing. The customer must ensure that the email address provided for order processing is correct and valid so that emails sent by the seller can be received at that address. In particular, if the customer uses spam filters, they must ensure that all emails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.

4. Right of Withdrawal

4.1 If you are a consumer (i.e., a natural person placing an order for a purpose unrelated to your commercial or self-employed professional activities), you have a right of withdrawal in accordance with the statutory provisions.

4.2 If, as a consumer, you exercise your right of withdrawal under Section 4.1, you must bear the standard costs of return shipping.

4.3 In all other respects, the provisions set forth in detail in the following section apply to the right of withdrawal:

A. Right of Withdrawal Policy

Right of Withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the goods.

You may use the attached model withdrawal form for this purpose, but this is not required.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you cancel this contract, we must refund all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without delay and no later than fourteen days from the day we receive notice of your cancellation of this contract. We will use the same payment method you used for the original transaction for this refund, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without delay and, in any case, no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you ship the goods before the fourteen-day period expires.

You are responsible for the direct costs of returning the goods. We recommend including a tracking number when returning the goods, as we cannot guarantee a refund if the shipment is lost in transit.

You are liable for any loss in value of the goods only if such loss is attributable to handling of the goods that goes beyond what is necessary to assess their nature, characteristics, and functionality.

Exclusion or Premature Termination of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts involving the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if the seal has been broken after delivery.

The right of withdrawal expires prematurely for contracts for the delivery of audio or video recordings or computer software in sealed packaging if the seal has been broken after delivery.

The right of withdrawal expires prematurely for custom-assembled products, such as mystery boxes and Advent calendars.

The right of withdrawal also expires prematurely for discounted items.

Please make sure to record an unboxing video of your order to provide proof of any missing items or missing inserts. We cannot offer a refund for missing contents if the items have been opened and/or no proof of unboxing is provided.

Please note: the outer packaging is intended solely to protect the contents, i.e., the product itself. Therefore, minor damage to the outer packaging—such as slight dents, creases, or scratches—does not constitute grounds for a complaint. With some products, especially stuffed animals and similar items, manufacturing processes may also result in minor product variations (e.g., loose thread ends, small holes in the stitching, etc.). These are noted on the individual product pages. These variations are also not grounds for a complaint.

General Information

1) Please avoid damaging or soiling the merchandise. Please return the merchandise to us in its original packaging, including all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against damage during shipping.

2) Please do not return the merchandise to us with shipping charges unpaid.

3) Please note that the provisions in sections 1–2 above are not prerequisites for the effective exercise of the right of withdrawal.

5. Prices and Shipping Costs

5.1 The prices listed on the product pages include the statutory value-added tax and other price components.

5.2 In addition to the listed prices, we charge a flat rate of 6.20 euros per order for delivery within Germany. The shipping costs are clearly displayed again on the product pages, in the shopping cart, and on the order page.

5.3 Your order is eligible for free shipping if the order total is 80.00 Euro or more.

5.4 Any additional delivery and shipping costs, if applicable, are listed separately in the respective product description or in the shopping cart.

6. Delivery

6.1 We will not ship the goods until we have received full payment.

6.2 For orders that include pre-orders, we will not ship the entire order until the pre-ordered items have arrived at our facility.

6.3 For our shipments, we strive to reuse as much material as possible to reduce packaging waste in circulation.

6.4 Deliveries within Germany and the EU are made via DHL.

6.5 Unless otherwise agreed, goods are delivered within the delivery area specified by the seller to the shipping address provided by the customer. The delivery address specified in the seller’s order processing system is decisive for the transaction. If delivery of the goods fails for reasons attributable to the customer, the customer shall bear the reasonable costs incurred by the seller as a result. This does not apply to the costs of the initial shipment if the customer effectively exercises their right of withdrawal. If the customer effectively exercises the right of withdrawal, the provisions set forth in the seller’s withdrawal policy shall apply to return shipping costs.

6.6 The delivery time is up to 10 days. We will indicate any deviating delivery times on the respective product page.

6.7 The seller reserves the right to withdraw from the contract in the event of incorrect or improper delivery by its supplier. This applies only if the seller is not responsible for the non-delivery and has entered into a specific covering transaction with the supplier with due care. The seller will make every reasonable effort to procure the goods. In the event that the goods are unavailable or only partially available, the customer will be notified immediately and the purchase price will be refunded without delay.

6.8 If the customer is acting as a business, the risk of accidental loss and accidental deterioration of the sold goods passes to the customer as soon as the seller has delivered the goods to the shipping agent, the carrier, or any other person or entity designated to carry out the shipment. If the customer is a consumer, the risk of accidental loss and accidental deterioration of the sold goods generally passes only upon delivery of the goods to the customer or to a person authorized to receive them.

6.9 If the Seller offers the goods for pickup, the Customer may pick up the ordered goods during the business hours specified by the Seller at the address provided by the Seller. In this case, no shipping costs will be charged.

6.10 Gift certificates are provided to the customer as follows:

6.11 Tickets are provided to the customer as follows:

7. Payment

7.1 Payment must be made in advance.

7.2 If you select the “payment in advance” option, we will provide you with our bank account information in the order confirmation and ship the goods after we receive payment.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Dispute Resolution

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
